Some traffic tickets are misdemeanors or felonies under New York’s Vehicle Traffic Law. You must be aware that New York State Vehicle and Traffic Law (VLT) can be a crime. A misdemeanor carries up to a year in jail plus a fine and surcharges. However, there may even be a felony charge and these carry even worse consequences. - VTL 600.2(a). Leaving the Scene of a Personal Injury Accident
- VTL 1182. Unauthorized Speed Contest
- VTL 1212. Reckless Driving
- VTL 306(e). Production of a Fake Certificate of Inspection
- VTL 319.2. Production of an Invalid Insurance ID Card
- VTL 340(a). Failure to Surrender License and Evidences of Registration
- VTL 375(1). Equipment Violation. Inadequate Brakes
However, many charges are simply speeding tickets under Vehicle and Traffic Law Section 1180(D) . Your speed determines how many points are assessed against your license. In turn, your license may be suspended if you violated the maximum number of points on your license. Therefore, you should defend every traffic ticket in the Capital District. Additionally, a speeding ticket under Vehicle and Traffic Law Section 1180(c) - Speeding in a School Zone may cause you additional penalties with additional fines and points. To be properly charged with violating VTL 1180(c), you must be issued the ticket during school hours. Often, school zones will have signs posted that the law is enforced from 7:00 am - 6:00 pm on school days. You should be careful in defending these cases.
